Terms of service

Effective 15 October 2026

Agreement

NanoGenesis is operated by Mochacidal Industries, LLC. By playing the game or creating an account, you agree to these terms. If you don't agree, please don't use the game. If you're under the age of majority where you live, you may only use the game with a parent or guardian's consent.

Your licence

We grant you a personal, non-exclusive, non-transferable licence to play the game for your own non-commercial enjoyment. The game and its art, code, names and content remain ours (or our licensors'). You may not copy, sell, rent, redistribute or reverse-engineer it, except where the law says you can't be stopped from doing so.

Accounts

Signing in is optional. Keep your credentials safe — you're responsible for activity on your account — and use one account per person. We may suspend or close an account that breaks these terms.

You can delete your account at any time from Settings → Delete account. That removes your account and any cloud save.

Purchases and virtual goods

Purchases — perpetual production boosts and the Star Pack — are one-time payments processed by Stripe. Entitlements are tied to your account and have no cash value: they can't be transferred, traded or cashed out, and they end if your account is deleted.

Prices and item contents may change over time, and items may be changed or retired.

Refunds

If you live in the EEA or the UK, you normally have 14 days to withdraw from a digital purchase. By buying, you ask us to give you access immediately and you acknowledge that you lose that right once the content is delivered.

Otherwise purchases are generally final — but if something didn't work, or you were charged twice, contact tech@mochacidal.com and we'll put it right.

Acceptable use

Don't attack or overload our infrastructure, resell access to the game, use cheats that break the service or affect other players, or use the game for anything unlawful.

Availability and changes

The game is a living project. We may add, change, rebalance or remove features, take it offline for maintenance, or discontinue it. We'll try to give notice of anything major.

The game is still pre-1.0. While it's in that state, an update may occasionally change the save format in a way that makes an existing save incompatible. When that happens we'll call it out loudly in the changelog, and you may have to start a new game — so please don't rely on any particular progress surviving every update.

Disclaimers

The game is provided “as is”, without warranties of any kind to the extent the law allows. We don't promise it will always be available or error-free, or that progress will never be lost.

Liability

To the extent the law allows, we're not liable for indirect or consequential losses, or for lost progress or data. Nothing here limits rights you have under mandatory consumer law, and our total liability is limited to what you paid us in the previous 12 months.

Termination

You can stop using the game at any time. We may suspend or end your access if you break these terms. Deleting your account ends this agreement, except for terms that by their nature should survive (such as the licence restrictions and liability).

Governing law and contact

These terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules. Questions? Contact tech@mochacidal.com.

Changes to these terms

We may update these terms. The effective date above will change, and material changes will be noted in the in-game changelog.
